Terms & Conditions

The rules that govern use of the TutorEd platform.

These Terms & Conditions govern your use of TutorEd and the services available through tutored.online.

By creating an account, booking a lesson, making a payment, or otherwise using TutorEd, you agree to these Terms.

These Terms should be read together with our:

1. About TutorEd

TutorEd is an online tutoring platform operated by Isha Patel, trading as TutorEd, as a sole trader.

TutorEd enables students and parents or guardians to find approved tutors, communicate with them, book online tutoring sessions and make payments through the Platform.

References to “TutorEd”, “we”, “us” or “our” mean the person operating TutorEd.

2. Definitions

In these Terms:

  • Account means a registered TutorEd account.
  • Booking means a booking made through TutorEd for a Lesson or Free Introductory Call.
  • Guardian means a parent, legal guardian or responsible adult associated with a Student where applicable.
  • Lesson means a paid online tutoring session booked through TutorEd.
  • Platform means the TutorEd website, dashboards, booking system, messaging system, online-classroom functionality and associated services.
  • Student means the person receiving tutoring.
  • Tutor means an individual approved by TutorEd to provide tutoring through the Platform.
  • User means any Student, Guardian or other person using TutorEd.

3. Accounts

  • Users must provide accurate and current information when creating and using an Account.
  • You are responsible for keeping your login details secure.
  • You must not knowingly allow another person to access your Account without permission.
  • You must notify TutorEd promptly if you believe your Account has been compromised.
  • TutorEd may require identity or other verification where reasonably necessary for security, safeguarding, payment, fraud-prevention or legal purposes.

4. Students Under 18

TutorEd may provide tutoring to Students under the age of 18.

Where appropriate, TutorEd may require details of a parent or Guardian.

A parent or Guardian using TutorEd on behalf of a Student is responsible for ensuring that:

  • the Student’s information is accurate;
  • they have authority to make bookings and payments for the Student;
  • the Student follows these Terms and TutorEd’s Safeguarding Policy.

TutorEd may communicate with the Guardian regarding bookings, payments, cancellations, safeguarding concerns and other matters relating to the Student.

5. Tutors

Tutors must complete TutorEd’s applicable recruitment and approval process before being permitted to provide paid tutoring through the Platform.

This may include:

  • application screening;
  • interviews or assessments;
  • identity verification;
  • DBS or other safeguarding checks where required;
  • training; and
  • final approval by TutorEd.

Tutors are subject to separate Tutor Terms.

TutorEd’s approval of a Tutor does not guarantee that a particular Tutor will be suitable for every Student or guarantee any particular academic outcome.

6. Tutor Profiles

Tutor profiles may include information such as:

  • subjects and levels taught;
  • education and qualifications;
  • tutoring experience;
  • availability;
  • hourly rate;
  • reviews;
  • other relevant profile information.

TutorEd takes reasonable steps to ensure information displayed on the Platform is accurate but cannot guarantee that all Tutor availability or profile information will remain unchanged.

Students and Guardians are responsible for choosing a Tutor they consider appropriate.

7. Free Introductory Calls

TutorEd may allow a Student to book a Free Introductory Call with a Tutor.

A Free Introductory Call:

  • is not a paid Lesson;
  • does not require the Student to make a subsequent booking;
  • does not guarantee the Tutor’s future availability; and
  • must comply with TutorEd’s safeguarding and conduct rules.

8. Booking a Lesson

TutorEd currently offers individual online Lessons of the duration shown at the time of booking.

Before completing a Booking, the User will be shown the material information relating to that Lesson, including:

  • Tutor;
  • subject;
  • date;
  • start time;
  • duration; and
  • price.

A paid Booking is confirmed only after TutorEd has received confirmation of successful payment.

A displayed Tutor time slot may cease to be available before payment is completed.

TutorEd may refuse or cancel a Booking where reasonably necessary because of:

  • payment failure;
  • suspected fraud;
  • safeguarding concerns;
  • Tutor unavailability;
  • technical error;
  • breach of these Terms; or
  • another legitimate operational or legal reason.

If TutorEd cancels a paid Lesson that has not been provided, the Student will receive the refund required under these Terms, our Cancellation & Refund Policy and applicable law.

9. Payments

  • Payments for Lessons must be made through TutorEd’s approved payment system.
  • The total Lesson price will be shown before payment is confirmed.
  • Users must use a payment method that they are authorised to use.
  • TutorEd uses a third-party payment provider to process payments.
  • TutorEd is not responsible for a payment being declined by a User’s bank, card issuer or payment provider.
  • Students and Tutors must not use TutorEd to arrange off-platform payments intended to avoid TutorEd’s payment system or protections.

10. Consumer Rights and 14-Day Cancellation Rights

Nothing in these Terms restricts any statutory rights available to consumers.

Where applicable, a consumer entering into a service contract online may have a statutory right to cancel that contract during a 14-day cancellation period.

A Student or Guardian may nevertheless request that a Lesson takes place during that period.

Where required by law, TutorEd may ask the User expressly to request that performance begins before the statutory cancellation period has ended.

Where the relevant service has been fully performed during that period and the User has given the legally required acknowledgement, the statutory right to cancel that completed service may be lost.

Where a service has begun but has not been fully performed before a valid statutory cancellation, the User may be required to pay an appropriate amount for services already supplied where permitted by law.

TutorEd’s ordinary Lesson cancellation rules operate separately from these statutory rights.

11. Lesson Cancellation

Students and Guardians can cancel eligible Lessons through TutorEd.

TutorEd operates a 24-hour cancellation window.

Where a Student cancels a Lesson more than 24 hours before the scheduled start time, the Lesson will normally qualify for a full refund.

Where a Student cancels within 24 hours of the scheduled start time, any refund will be determined in accordance with:

  • TutorEd’s Cancellation & Refund Policy;
  • the circumstances of the cancellation;
  • any direct loss resulting from the late cancellation; and
  • applicable consumer law.

TutorEd may issue a full refund in exceptional circumstances at its discretion where appropriate.

Nothing in this section overrides statutory consumer rights.

12. Rescheduling

Where rescheduling is available, it must be completed through TutorEd and is subject to Tutor availability.

Any applicable rescheduling deadlines will be shown or described in TutorEd’s Cancellation & Refund Policy.

TutorEd does not guarantee that the original Tutor will have another suitable time available.

13. Student Lateness

Students should join Lessons at the scheduled start time.

If a Student joins late, the Tutor is not normally required to extend the scheduled end time.

A Lesson may still be treated as completed where the Student attends late but receives the remainder of the booked session.

14. Student No-Shows

If the Student has not joined the Lesson within 15 minutes of the scheduled start time, the Tutor may leave the classroom and the Lesson may be recorded as a Student no-show.

A Student no-show will normally not qualify for a refund, subject to:

  • TutorEd’s Cancellation & Refund Policy;
  • any technical failure attributable to TutorEd;
  • exceptional circumstances approved by TutorEd; and
  • applicable law.

15. Tutor Lateness

Tutors are expected to join Lessons on time.

TutorEd currently allows a short grace period of up to 5 minutes for minor Tutor lateness.

Where a Tutor arrives later than this, TutorEd may consider whether:

  • missed time was made up;
  • the Student received the full tutoring time;
  • the Lesson should be treated as completed;
  • an exception requires Admin review; or
  • a refund should be issued.

16. Tutor No-Shows

If a Tutor has not joined within 15 minutes of the scheduled Lesson start time, the Lesson may be treated as a Tutor no-show.

Where a Tutor no-show prevents the Student from receiving the booked Lesson, the Student will receive a full refund for that Lesson.

TutorEd may also take action against the Tutor under the Tutor Agreement.

17. Tutor Leaving Early

Tutors are expected to provide the booked Lesson duration.

Where a Tutor leaves early but subsequently makes up the missed tutoring time in accordance with TutorEd’s rules, the Lesson may still be treated as completed.

Where Tutor-caused missed time is not made up, TutorEd may refer the Lesson for Admin review and determine the appropriate outcome or refund.

18. Online Classroom

Lessons are delivered through TutorEd’s approved online-classroom technology.

Users are responsible for having:

  • a suitable device;
  • a stable internet connection;
  • a supported browser;
  • working audio equipment; and
  • where required, a functioning camera.

Users should attempt to join promptly so technical problems can be identified.

TutorEd is not generally responsible for technical failures caused solely by a User’s own device, equipment or internet connection.

Where a material failure of TutorEd’s systems or the integrated classroom prevents a Lesson from taking place, TutorEd will investigate and determine the appropriate remedy.

19. Attendance and Lesson Records

TutorEd may automatically collect technical attendance information, including:

  • first join time;
  • leave time;
  • session start and end time;
  • duration of attendance; and
  • relevant classroom events.

This information may be used to:

  • determine whether a Lesson took place;
  • identify lateness or no-shows;
  • determine Tutor payout eligibility;
  • assess refund eligibility;
  • investigate disputes;
  • address safeguarding concerns;
  • identify misuse or fraud.

This information is handled in accordance with TutorEd’s Privacy Policy.

20. Lesson Outcomes

TutorEd may assign a Lesson an outcome after its scheduled completion.

Possible outcomes may include:

  • completed;
  • Student no-show;
  • Tutor no-show;
  • cancelled; or
  • exception requiring Admin review.

TutorEd may use attendance data, cancellation records and other relevant information when determining an outcome.

Where an automated determination cannot fairly resolve a situation, TutorEd may refer it for manual Admin review.

21. Refunds

TutorEd’s refund system generally operates on a full-refund or no-refund basis rather than issuing tutoring credits.

A full refund may be issued where required under TutorEd’s Cancellation & Refund Policy or applicable law.

TutorEd may also issue an exceptional full refund following Admin review where appropriate.

TutorEd does not guarantee a refund merely because a User is dissatisfied with a Lesson where the agreed tutoring service was properly provided.

22. Messaging

TutorEd may provide messaging between Students, Guardians and Tutors.

Users must not use TutorEd messaging to:

  • harass or threaten another person;
  • send sexual, abusive, discriminatory or unlawful material;
  • circumvent safeguarding protections;
  • solicit prohibited off-platform payments;
  • impersonate another person;
  • distribute malicious files;
  • engage in fraud; or
  • otherwise misuse TutorEd.

TutorEd may investigate relevant communications where reasonably necessary for safeguarding, security, complaints, fraud prevention or enforcement of these Terms, in accordance with applicable law.

23. Safeguarding

All Users must comply with TutorEd’s Safeguarding Policy.

TutorEd may take immediate action where it reasonably identifies a safeguarding concern.

This may include:

  • restricting communication;
  • suspending an Account;
  • cancelling Lessons;
  • preserving relevant records;
  • contacting a Guardian;
  • removing a Tutor from the Platform;
  • referring a concern to an appropriate safeguarding organisation, regulator or law-enforcement body where appropriate.

Safeguarding obligations take priority over ordinary Platform procedures where necessary to protect a child or vulnerable person.

24. DBS and Tutor Verification

Where TutorEd requires a Tutor to provide DBS, identity or other verification information, the Tutor must complete that process before being permitted to provide tutoring where TutorEd’s policies require it.

TutorEd may prevent a Tutor profile from going live, suspend a Tutor or remove a Tutor where required checks have not been completed or maintained.

25. User Conduct

Users must not:

  • provide deliberately false information;
  • impersonate another person;
  • harass, threaten or abuse another User;
  • discriminate unlawfully;
  • misuse TutorEd’s systems;
  • attempt to access another User’s Account;
  • interfere with TutorEd’s security;
  • commit or facilitate fraud;
  • manipulate reviews;
  • upload harmful software;
  • breach safeguarding requirements;
  • arrange prohibited off-platform payments; or
  • use TutorEd for unlawful purposes.

26. Off-Platform Arrangements

TutorEd’s payment, messaging and safeguarding systems exist partly to protect Students and Tutors.

Users must not intentionally use TutorEd to establish a tutoring relationship and then circumvent TutorEd’s payment or safeguarding systems in breach of these Terms or the Tutor Agreement.

TutorEd may investigate suspected attempts to bypass the Platform.

27. Reviews

Students or Guardians may be invited to leave a review of a Tutor.

Reviews must:

  • relate to a genuine experience;
  • be truthful to the reviewer’s knowledge;
  • not contain abusive or discriminatory content;
  • not contain unlawful material;
  • not reveal another person’s private information improperly.

TutorEd may remove reviews that breach these rules or where reasonably necessary to protect the integrity of the Platform.

TutorEd will not normally remove a genuine negative review simply because the Tutor disagrees with it.

28. Complaints and Disputes

Users should contact TutorEd promptly if they experience a problem relating to a Lesson, Tutor behaviour, Student behaviour, payment, cancellation, refund, safeguarding, technical failure or another Platform issue.

TutorEd may consider evidence including:

  • Booking information;
  • attendance records;
  • messages;
  • payment information;
  • cancellation timestamps;
  • User statements; and
  • other relevant records.

TutorEd may temporarily place a Tutor payout on hold while a genuine Lesson dispute is being investigated.

29. Tutor Payments

Tutor payments and TutorEd’s commission arrangements are governed by the separate Tutor Agreement.

TutorEd may delay or withhold a Tutor payout relating to a particular Lesson where:

  • the Lesson has not yet been completed;
  • the Lesson is under dispute;
  • the outcome is awaiting determination;
  • a refund may be required;
  • there is suspected fraud;
  • there is a safeguarding issue; or
  • payment cannot legally or technically be made.

Student-facing prices shown at checkout are not affected by how TutorEd subsequently divides revenue with Tutors.

30. Intellectual Property

The TutorEd name, branding, website design, software, text and other Platform material belong to TutorEd or its licensors unless stated otherwise.

Users must not copy, reproduce, commercially exploit or redistribute protected TutorEd material without permission.

Tutors retain ownership of original teaching resources they create unless otherwise agreed.

Students may use Tutor-provided materials for their own personal educational purposes but may not commercially reproduce or redistribute them without permission from the relevant rights holder.

31. Educational Results

Tutoring can support academic development, but TutorEd and Tutors do not guarantee:

  • examination results;
  • particular grades;
  • university or school admission;
  • a specified improvement in performance; or
  • any other particular academic outcome.

Results depend on many factors outside TutorEd’s control.

32. Third-Party Providers

TutorEd uses third-party providers to operate parts of the Platform, which may include services for:

  • payment processing;
  • video/classroom functionality;
  • email delivery;
  • website hosting;
  • authentication;
  • infrastructure and security.

Information about how personal data is shared with service providers is set out in TutorEd’s Privacy Policy.

33. Availability of TutorEd

TutorEd aims to provide a reliable Platform but cannot guarantee uninterrupted availability.

Access may occasionally be interrupted because of:

  • maintenance;
  • technical problems;
  • third-party outages;
  • security incidents;
  • legal requirements; or
  • circumstances outside TutorEd’s reasonable control.

TutorEd will take reasonable steps to minimise disruption.

34. Account Suspension and Termination

TutorEd may suspend or terminate an Account where there are reasonable grounds to believe that a User:

  • has materially or repeatedly breached these Terms;
  • presents a safeguarding risk;
  • has engaged in fraud;
  • has seriously misused TutorEd;
  • has attempted unauthorised access;
  • has behaved abusively;
  • has repeatedly failed to meet Tutor obligations; or
  • must be removed for legal or regulatory reasons.

TutorEd may act immediately in serious safeguarding, fraud or security cases.

Where appropriate, TutorEd will investigate before permanent termination.

Any money paid for future services that will not be provided will be handled in accordance with applicable law and TutorEd’s Cancellation & Refund Policy.

35. Liability

TutorEd will provide its services with reasonable care and skill.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, TutorEd does not exclude liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation; or
  • any liability that cannot legally be excluded.

TutorEd is not responsible for losses that were not reasonably foreseeable when the relevant contract was entered into.

Nothing in these Terms affects a consumer’s statutory rights.

36. Privacy and Data Protection

TutorEd processes personal data in accordance with applicable UK data-protection law and its Privacy Policy.

The Privacy Policy explains:

  • what information TutorEd collects;
  • why it is collected;
  • the lawful basis for processing;
  • who information may be shared with;
  • retention periods;
  • security measures; and
  • Users’ data-protection rights.

37. Changes to These Terms

TutorEd may update these Terms where reasonably necessary because of changes to:

  • TutorEd’s services;
  • Platform functionality;
  • law or regulation;
  • safeguarding requirements;
  • security requirements;
  • payment providers; or
  • third-party technology.

Where required, TutorEd will provide reasonable notice of material changes.

The Terms applying when a Booking is made will normally govern that Booking unless the law requires otherwise.

38. Severability

If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

39. No Waiver

If TutorEd does not immediately enforce a provision of these Terms, this does not mean TutorEd has permanently waived its right to enforce it.

40. Third-Party Rights

Unless expressly stated otherwise, no person who is not a party to these Terms may enforce them under the Contracts (Rights of Third Parties) Act 1999.

41. Governing Law

These Terms are governed by the laws of England and Wales.

Consumers may also benefit from mandatory legal protections applicable in the part of the United Kingdom where they live.

Any dispute will be dealt with by the courts having jurisdiction under applicable law.
